These terms and conditions regulate the conditions for participating in the current Facebook or Instagram  competition of Gebrüder Weiss. 

By participating in the competition, the participant accepts these conditions.

The organizer of the competition is Gebrüder Weiss GmbH, Bundesstrasse 110, 6923 Lauterach, Austria.

Right of participation:  

All persons who are at least 18 years old at the time of participation are eligible to participate. A further prerequisite is that the participation in the competition does not constitute a violation of the compliance guidelines (e.g. gift acceptance guidelines for employees of customers of the organizer) that apply to the participant. 

All employees of the Corporate Brand Strategy and Communications department of Gebrüder Weiss GmbH are excluded from participation. The participation of public officials is also excluded.

Participation with forged identities or identities of third parties is not permitted.

Participation: 

Eligible persons may participate in the competition by using the comment function under the competition or send an e-mail to socialmediagw-world.com to publish the content required in the description of the competition (e.g. photo, answer to a question in the competition) and not withdrawing the publication until the winners have been selected.

Participation is possible until the deadline stated in the description of the competition.

Prizes:

Gebrüder Weiss will raffle off the winnings specified in the description of the competition among all persons entitled to participate, provided that the prerequisites for winning are met (e.g. correct photo or correct answer).

Winners will be voted by the employees of Gebrüder Weiss within one week after the participation deadline. Winners will be notified via direct messages and are requested to answer to the organizer within five working days. If a winner does not respond within this period, the prize is forfeited.

The prize is neither transferable nor can it be exchanged. Legal recourse and cash payment are excluded. Only one prize per participant is possible. The distribution of the prize is made by the organizer. The prize will be sent to the winner.

Gebrüder Weiss is entitled to publish winners permanently on the Facebook or Instagram page of Gebrüder Weiss with their first name and the first letter of their surname as well as the contents published for participation. 

Responsibility for and rights to contents of the participant:

The participant grants the organizer a free, simple, globally valid, permanent, transferable and sub-licensable right of use to the contents published on the Facebook or Instagram page of Gebrüder Weiss for promotional/communicative purposes in connection with the competition, in particular for advertising, presentation and documentation of the competition. This includes in particular the right to reproduce, distribute and publicly reproduce the contributions with pictures or comments. 

The participant assures that contents published by him on the Gebrüder Weiss Facebook or Instagram page are free of third-party rights and indemnifies the organizer against third-party claims in this respect. Participants are solely responsible for all content they provide on Facebook or Instagram in connection with the competition. The content must not be an insult to other users or third parties and must not slander, harass or damage other users or third parties in any way, infringe any (other) rights of third parties (in particular personal rights, copyrights and ancillary copyrights), advertise for third parties (in the form of links, texts and/or images) and contain no immoral, obscene, pornographic, threatening, violent, discriminatory or racist objects.

Exclusion and changes:

In the event of a violation of these conditions of participation, the organizer is entitled to exclude the participant from participation at a later date. This applies in particular if the participant is not entitled to participate or if false information is provided or if the participant publishes infringing content on the Facebook or Instagram page of the organizer. Such content may be deleted by the organizer without prior notice. If the excluded participant is a winner who has already been drawn, the prize may be subsequently withdrawn. A substitute draw will not take place.

The organizer reserves the right to terminate the competition prematurely at any time, even without observing deadlines, in whole or in part, or to modify it in its course, if it is not possible for technical (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons to guarantee a proper execution of the competition.

Disclaimer:

The competition has no connection with Facebook or Instagram and is in no way sponsored, supported or organized by Facebook or Instagram. Each participant indemnifies Facebook or Instagram against any claims related to the competition. Any questions, comments or complaints regarding the competition should be directed to Gebrüder Weiss (socialmediagw-world.com).

Final provisions: 

If the conditions of participation contain ineffective provisions, the effectiveness of the conditions shall remain unaffected.

The law of the Republic of Austria shall apply.

For all legal disputes arising from or in connection with these conditions of participation and the competition, the place of jurisdiction shall be the registered office of the organizer.

Data protection notice:

If you participate in the Facebook competition, we will process the personal data of you associated with your participation and disclosed to us by you in order to carry out the competition and identify you as an entitled participant, as well as for any prize determination and notification and the dispatch of any prize.

This processing of the data takes place upon your participation and is required according to Art. 6 (1) lit. b GDPR for the aforementioned purposes for your participation and the execution and handling of the competition.

Data will only be passed on if this is necessary within the framework of the competition (e.g. delivery of the prize). 

Any further processing by us will not take place. The personal data of the winners will be deleted at the latest after 3 years at the end of the year after the end of the competition. An earlier deletion is not possible in order to be able to trace the entries within the scope of a legal claim. Please note, however, that the content published by you as part of your participation is linked to your Facebook or Instagram name and also to your Facebook profile and can therefore be permanently accessed via our Facebook or Instagram page. Please note the setting option for the public visibility of your profile on Facebook or Instagram.
